Welcome to sipit.ro! These Terms and Conditions govern the use of our website and the purchase of Sipit products. We know that T&Cs are not the most exciting reading, but we have tried to make them as clear and straightforward as possible. No unnecessary legal bullshit, just what you need to know.
1. COMPANY INFORMATION
The company Better Soda SRL, with the email address hello@sipit.ro , is the owner and operator of the website sipit.ro and the trademark Sipit.
2. DEFINITIONS
In these Terms, "We", "Sipit" or "Company" refers to Better Soda SRL. "You", "Customer" or "User" refers to the individual or legal entity accessing our website or purchasing our products. "Products" refers to Sipit prebiotic drinks and any other products offered through our website. "Site" refers to sipit.ro and all its associated subdomains.
3. ACCEPTANCE OF TERMS
By accessing and using our website or by placing an order, you expressly confirm that you have carefully read, fully understood and agree to all the provisions contained in these Terms and Conditions. You also confirm that you are at least 13 years of age or have obtained the consent of your parents or legal guardians for the use of your personal data, in accordance with applicable data protection regulations.
4. PRODUCTS AND PRICES
Sipit products are an innovative range of prebiotic carbonated drinks, characterized by low sugar and calorie content, created to provide a healthy and delicious alternative to traditional drinks. Each product is carefully designed with natural ingredients and prebiotic fibers to support digestive health. The full ingredients, detailed nutritional information and specific benefits of each product are clearly displayed on the dedicated page of each item on the site.
All prices displayed on the site are expressed in lei and include value added tax (VAT) according to the legislation in force. We reserve the right to change product prices at any time, without prior notice, but the applicable price for your order will be the one displayed on the site at the time of order completion and confirmation.
Product availability is subject to stock availability at the time of order placement. In the event that an ordered product becomes unavailable after order confirmation, we will immediately notify you of this situation and offer you the option to choose an alternative product or cancel the order with a full refund of the amount paid.
5. ORDERS AND PAYMENTS
Orders can be placed exclusively through our website, following the simple and intuitive steps of the checkout process. Confirmation of an order constitutes a firm offer to purchase from you, and the sales contract is considered concluded when we accept your order by sending you the electronic confirmation.
For customers who want a convenient and regular shopping experience, we offer subscription services with recurring deliveries. You can choose from weekly, biweekly or monthly subscriptions, depending on your preferences and consumption needs. Subscriptions are automatically billed according to the chosen periodicity, and payment is made through the payment method configured in your account. You have complete flexibility to cancel your subscription at any time directly from your user account, with the cancellation taking effect on the next scheduled billing cycle.
We accept various payment methods for your convenience, including credit or debit card payment, PayPal, bank transfer or cash on delivery in areas where this service is available. After successfully completing your payment, you will immediately receive a detailed confirmation by email with all the information about your order. For payments made by card, the authorization and validation of the transaction is done in real time.
6. DELIVERY AND TRANSPORTATION
Currently, our delivery services cover the entire territory of Romania through our authorized and trusted courier partners. We are working to bring Sipit to other countries, the bubbles will find their way there too.
The standard delivery time for all areas in Romania is 2-3 business days from order confirmation and processing. This time may vary depending on the geographical area of destination, adverse weather conditions, high volume of orders during peak periods or other unpredictable circumstances that may affect transportation services.
Shipping costs are automatically calculated based on the weight and destination of the order and are displayed transparently during the checkout process, before the order is completed. Normally, these costs are borne by the customer, except in cases where we offer special promotions with free shipping, which will be clearly stated in the description of the respective offer.
The risk of loss, damage or other transport-related issues passes to you upon actual delivery and confirmation of receipt of the package by you or a person authorized to receive the package on your behalf.
7. RIGHT OF WITHDRAWAL AND RETURNS
In accordance with European and Romanian consumer protection legislation, you have the legal right to withdraw from the contract for a period of 14 calendar days from the date of receipt of the products, without being obliged to justify this decision and without incurring any costs other than those of return.
To exercise this right, you must notify us of your decision to withdraw by sending a clear message to the email address hello@sipit.ro . The products must be returned in their original packaging, in an unconsumed and unaltered condition, accompanied by all accessories and documents received with them. The costs related to the return of the products are borne by you, except in situations where the return is due to an error on our part or the failure of the products.
The full refund of the value of the returned products will be made within a maximum of 14 calendar days from the date on which we confirmed receipt and acceptance of the return. The refund will be made using the same payment method used for the initial transaction, except in cases where you expressly consent to a different method.
We cannot accept returns of products that have been consumed, damaged through your fault, or whose packaging has been damaged through your negligence, except in situations where the damage occurred due to causes beyond your control.
8. PRODUCT WARRANTY
We guarantee that all Sipit products comply with the detailed descriptions on the site, have the declared qualities and properties, and comply with the high standards of quality and food safety that we have assumed. If you discover quality defects, non-conformities with the description or other problems related to the products, please report these issues to us within a maximum of 48 hours of receiving the package.
For products that have defects or non-conformities attributable to us, we offer free replacement with new products or a full refund, at your choice. In these specific situations, all shipping costs for replacement or return are borne by us.
9. HEALTH INFORMATION
Sipit products are classified as functional foods and are not medicines, medical supplements or treatments for various conditions. They are not intended to replace a varied and balanced diet or a healthy lifestyle, but to beneficially complement them.
If you have specific health concerns, known food allergies, particular medical conditions or are undergoing medical treatments, we recommend that you consult your family doctor or a specialist before regularly consuming our products. Please carefully check the full list of ingredients displayed on each product to identify potential allergens that may affect you.
10. PROTECTION OF PERSONAL DATA
We collect and process your personal data exclusively to the extent necessary to fulfill our contractual obligations, to communicate effectively with you as a customer, and to continuously improve our services. The main purposes for which we use your data include processing and managing orders, coordinating deliveries, communicating about the status of orders and products, marketing and advertising activities (only with your express consent), and analyzing web traffic through tools such as Google Analytics to optimize the user experience.
We do not sell, rent or otherwise trade your personal data to third parties. We share your information only with our trusted partners and only to the extent strictly necessary: with courier companies to fulfill deliveries, with payment processors to complete transactions, and with Google Analytics to analyze web traffic (in anonymized format).
You have full rights over your personal data, including the right to access the information we hold about you, the right to rectify incorrect data, the right to erase data under certain conditions, and the right to data portability. 11. INTELLECTUAL PROPERTY
The entire content of our website, including but not limited to texts, images, photographs, logos, graphics, videos, website design and interface elements, is protected by copyright, intellectual and industrial property rights, and belongs exclusively to Better Soda SRL or our licensors.
The name "Sipit", the associated logos and all distinctive brand elements are registered or pending trademarks of Better Soda SRL. Unauthorized use of these elements is strictly prohibited and may constitute a violation of intellectual property rights.
We grant you a limited, non-exclusive, revocable license to browse and view the content of the site for your personal, non-commercial use. Any other use, including copying, distribution, modification, or commercial exploitation of the content, requires our prior written consent.
12. LIMITATION OF LIABILITY
Our contractual and non-contractual liability is limited to the total value of the products purchased by you in the transaction that gave rise to the damage. This limitation applies to the extent permitted by applicable law and does not affect your statutory rights as a consumer.
We are not liable for indirect, incidental, consequential or punitive damages, including but not limited to lost profits, lost data, lost business, or other economic losses that may result from the use of our products or the site. We are also not liable for the consequences of incorrect, abusive or non-in accordance with the instructions use of our products.
In cases of force majeure, including but not limited to natural disasters, social conflicts, government actions, public service disruptions, pandemics or other unforeseeable and unavoidable events, our liability for delay or failure to perform contractual obligations is suspended for the duration and to the extent affected by these events.
13. COMMUNICATIONS
All official communications, legal notifications and correspondence with legal value must be sent to the email address hello@sipit.ro or to our postal address: Jud. Brăila, Sat Căzașu, Commune Căzașu, Str. Zambilelor no. 33. Communications sent through these official channels are considered validly delivered and produce full legal effects.
With your express consent, we may send you commercial communications, promotional offers, information about new products and other marketing materials via email or other available communication channels. You can withdraw your consent and unsubscribe from these communications at any time by using the unsubscribe links in the messages you receive or by contacting us directly.
14. CHANGES TO THE TERMS
We reserve the right to modify, update or supplement these Terms and Conditions at any time to reflect changes in our business, applicable legislation or to improve the services offered. Major changes that significantly affect your rights or obligations will be communicated by email or by visible notice on the site at least 30 days before they come into effect.
Your continued use of our site or services after the changes become effective constitutes your acceptance of the new terms. We encourage you to periodically review these Terms to stay informed of any updates.
15. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions, as well as any disputes arising from the contractual relationship between us, are governed exclusively by Romanian law, without prejudice to your rights as a consumer provided for by consumer protection legislation.
We always try to resolve any disagreements or disputes through direct dialogue, amicable negotiation and good faith. In the event that we fail to reach a satisfactory solution for both parties, disputes will be resolved by the competent courts of Romania, according to the rules of jurisdiction provided for by the civil procedure law.
For consumers in the European Union, the online alternative dispute resolution (ODR) platform is available at http://ec.europa.eu/consumers/odr/ , which you can use for the out-of-court resolution of commercial disputes.
